TEXTILE TRADE BUDDY DELIVERY AND SHIPPING POLICY
1. GENERAL
1.1. Texperts India Private Limited, having its registered office at 3, Commerce Centre Vishweshwanagar Road, Gujarat Ind Comp, Goregaon (E), Mumbai - 400063, Maharashtra, India (“Texperts”, “Company”, “we”, “us” or “our”) is managing and operating as a Master Licensee for India, the Platform “Textile Trade Buddy”, http://www.textiletradebuddy.com owned and developed by Textech Marketplace Company Limited, Unit 13, 16/F, Asia Trade Centre, No.79 Lei Muk Road, Kwai Chung, N.T., Hong Kong (collectively referred to as the “Platform” or “Website” or “Textile Trade Buddy”), which inter alia facilitate the sale and purchase of products and services listed and sold (“Products”) on the Platform. The term (“User” or “Users” or “you” or “your”, “yourself”, or “buyer” or “buyers”) means any individual on behalf of businesses which uses, accesses or browses the Platform and/or places the order and/or purchases the Products from the Platform.
1.2. The ’Delivery and Shipping Policy’ published on the Platform shall be read in conjunction with the Terms & Conditions, as well as Cancellation, Return and Refund Policy. This ‘Delivery and Shipping Policy’ (“Policy”), along with the ‘Terms and Conditions’ and other polices on the Platform, together constitute a legal and binding agreement between Textile Trade Buddy and you, which shall comprise the terms under which Textile Trade Buddy will be delivering and shipping the Products purchased via Platform. Please read these terms carefully. The Company reserves the right to change or modify this Policy, at any time and at its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the Platform. By continuing to use the Services, you are confirming that you have read and understood the latest version of this Policy.
1.3. We provide shipping and delivery of our Products all over India. We aim to provide the best customer experience for the buyer by tying-up and partnering with leading logistics service providers to handle their order in the best possible way and to ensure that they have a hassle-free experience in receiving the Product that they have ordered from the Platform. We make all commercially reasonable endeavours to ensure that the Products are delivered to them in a timely fashion.
2. APPLICABILITY OF POLICY
2.1. By using Platform and/or initiating a request for purchase of Products on the Platform, a buyer agrees to be bound by the terms contained in this Policy. If the buyer does not agree to the terms contained in this Policy, they are advised not to transact on Platform. Please note that, we may from time to time change the terms of the Policy. Every time the buyer wishes to use Platform, please check the Policy to ensure that they understand the terms and conditions that apply at that time.
3. TERMS OF SHIPPING AND DELIVERY
3.1. We partner with third party logistics service providers in order to facilitate the shipping and delivery of your order (“Order”) to you (“Logistics Partners”). The details of the Logistics Partner responsible for processing the shipping and delivery of any Order placed by you through the Platform will be provided to you at the time such Order is processed and successfully handed over to the Logistics Partner by us. The Orders are typically dispatched within 8-10 business days from the date of receipt of your Order on Platform. In any case, the buyer will be provided with an estimated timeline for the delivery of the Order placed through Platform, which shall be communicated to the buyer on the Order Confirmation Page of our Platform and via email notification, when the Order is confirmed by us.
Upon dispatch of the Order, we will share tracking details and the estimated delivery timeline of the Order on your registered e-mail ID and/or mobile number provided by you/ registered with us. Orders may also be tracked on the Order Confirmation Page on the Platform. The Order status can be tracked after 24 (“Twenty-Four”) hours from the time of dispatch. You hereby acknowledge and agree that the estimated delivery timeline shared with you upon dispatch of your Order is only indicative, and may be affected by external factors beyond our control, such as traffic, vehicle accident, vehicle damage or breakdown, or any force majeure event such as natural calamity, war, lockdown, pandemic, endemic, etc. The Order may arrive before or after the estimated delivery timeline.
Furthermore, you agree and understand that though we facilitate shipping and delivery of the Order to the buyers through our Logistics Partners, we equally reserve the right to ship and deliver the Orders independently on our own without engaging any Logistics Partners or third-party service providers. You agree and understand that while our endeavour is to ship and deliver the Order all across India, we may, in our sole discretion determine a select list of areas that are unserviceable for delivery of a particular Product displayed on our Platform, from time to time. We or our Logistics Partners do not provide shipping and delivery services in such unserviceable areas and may not process your Orders on the Platform in such cases. You can find out if Textile Trade Buddy delivers to your location using the courier serviceability tool available on the product page. Please tap on “Check Delivery options” and enter your area PIN code in the respective field to get the required information about standard Order delivery time and for the Product selected. The PIN codes serviced by us are frequently updated, so if we do not deliver to your PIN code today, please come back and check to see if this has changed.
3.2. You agree and acknowledge that to facilitate timely delivery of the Order placed via our Platform, we will require specific information like your name, shipping address, billing address, landmarks, contact details, GST No., google location, copy of Purchase Order, etc. You shall ensure that all information that is submitted by you to on our Platform is true, complete, accurate, and sufficient to identify the actual place of delivery. You understand that you shall bear absolute liability in case of any failure by us in delivering the Order due to your failure to provide correct, complete, sufficient and accurate information at the time of placing the Order. It is further clarified that we shall not be liable in any manner and at any point in time due to your failure to provide correct and complete information to enable us to execute a successful delivery of the Order.
3.3. We will attempt to deliver the Order to your designated address within the estimated delivery timeline notified to you. We shall make three attempts to deliver the Order, and if the Order is not delivered in the third attempt, due to your non-availability or in case you are not available to accept the delivery of the Order, we reserve the right to cancel the Order at our sole discretion and the Order will be sent back to its original source. In case the delivery is refused by you or the person-in-charge at the delivery location, an OTP will be sent to your registered mobile number to confirm the refusal. In such event of non-acceptance of the delivery, we shall cancel your Order and return it to its original source. Please note that in the event of cancellation of the Order as described above, We reserve the right to deduct the shipping and delivery charges, and all ancillary expenses incidental to the return of the Order/Product, borne by us while processing any refunds subsequent to such cancellation.
3.4. Upon successful delivery, you or the person-in-charge at the location receiving the Order must verify the correctness and the quantity of the Order in the presence of the driver and confirm it by providing proper stamped acknowledgment of the same to the driver. Any packaging issues must be immediately notified to the driver and to us with documentary evidence such as a photograph. In the event that any discrepancy or shortage in the delivery is reported by you or the person-in-charge at the location at the time of receipt of the Order, We will promptly investigate the matter. Any necessary actions to address the reported issue, such as providing missing items or arranging for replacements, will be determined at our discretion. Please note that we shall not be held liable for discrepancies or shortages reported after the delivery has been accepted by you or the person-in-charge at the location.
3.5. While we make reasonable endeavours in ensuring that Orders are delivered to you in a timely manner and within the timeline notified to you, you accept and acknowledge that the delivery may be delayed on account of:
(a) Logistics issues beyond our control;
(b) Unsuitable weather conditions;
(c) Political disruptions, strikes, employee-lockouts, etc.;
(d) Acts of God such as floods, earthquakes, etc.;
(e) Delivery vehicle accident/breakdown; and
(f) Other unforeseeable circumstances.
In such events of delay, we shall make reasonable attempt to inform you by writing to your email ID and/or mobile number registered with us. We disclaim all liabilities that may arise on account of our failure to inform or notify you of delays in the delivery of Orders. Further, we shall be under no obligation to compensate you for any claim that may otherwise arise on account of delay in the shipment, delivery, or use of the Orders.
3.6 Furthermore, while we endeavor to engage logistics partners who handle goods with care, we acknowledge that despite our best efforts, there may be instances of loss of goods during transit, whether due to accidents or other unforeseen circumstances. In such cases, we shall promptly investigate the matter and take appropriate actions, which may include offering a replacement or issuing a refund to you at our discretion, provided that the loss occurred due to circumstances within our control or negligence. We reserve the right to assess each situation individually and determine the appropriate course of action.
3.7 We endeavour to engage Logistics Partners, employees, agents with highest regard for ethics and integrity; and who behave in a fashion that exudes thorough professionalism, competence, and good mannerism. You agree and acknowledge that the actions and inactions of delivery partners are not in our control, and it is not possible for us to monitor and observe each delivery personnel. Since we are merely facilitating the delivery of Order placed by you, we shall not be liable for any acts or omissions on part of our delivery agents, employees, or personnel and/ or the Logistics Partners or their employees, agents, or personnel including any deficiency in service on their part, wrong delivery of Product, time taken to deliver the Order, Product package tampering, misconduct, etc.
3.8 Once you place an order on the Platform, we process such order and hand over the purchased Product to our Logistics Partner. Buyer may receive a unique tracking identity number once the Order is handed over to the Logistics Partner, which will enable the buyer in tracking the status of delivery of the Order. The buyer may use the tracking identity number on the Platform and/or the mobile application of the Logistics Partner to check the status and location of the Order and its estimated time of delivery. Our operations and service teams coordinate with the Logistics Partners to ensure that the Orders are delivered to you at the earliest and make all reasonable efforts in ensuring that the Logistics Partners update the tracking status of the purchased Products on a real time basis. It is clarified that we engage third party service providers to effectuate deliveries of the Orders and hence, we do not guarantee the accuracy or correctness of the tracking status and the status may be subject to inconsistencies arising out of time-lags in updating the information and/ or other technical difficulties which are not in our control.
3.9 We reserve the right to charge or collect shipping fees on Orders from time to time. Shipping charges may vary based on the total value of the Order, type of Product, area of delivery, distance between pick-up and delivery location, product weight, dimensions, packaging, handling, insurance, payment mechanism, etc. The shipping fee is a value-added service charge for providing delivery and post-order services, including but not limited to, higher percentage of returned items from the customers. The shipping fees help us mitigate various costs incurred by the Platform and ensure smooth running and efficient customer service. In the event we charge a shipping fee for the delivery of an Order, such shipping fees will not be refunded by us pursuant to any return request raised by you. However, we may make exceptions, at our sole discretion, and refund the shipping fees in the event a defected, damaged, deficient, or incorrect Product/Order (for reasons attributable to, and accepted by us after due verification in our sole discretion) has been delivered. You acknowledge and accept that the title and risk of all Products ordered by you shall pass on to you upon successful delivery of the said Order at the address specified by you.
3.10 Return of purchased Products are facilitated through our reverse-Logistics Partners. On receipt of request for return of an Order, whether complete or partial, as the case may be, and the same being duly verified and acknowledged by us, our reverse-Logistics Partners shall get in touch with you in order to collect the said Order from the specified address. We process the return of all Orders in accordance with our Cancellation, Return and Refund Policy.
